Urban planning law
Urban planning law, or urban planning, is a specialised branch of administrative law that regulates construction and buildings in physical space, covering, for example:
- Land use regulations.
- Land use planning.
- Urban planning and its implementation.
- Administrative intervention in the market.
- The legal regime governing the valuation of land and existing facilities, constructions and buildings on it.
- Compulsory purchase and financial liability arising thereform.
Currently, urban planning is a regional competence transferred from the State, which means that the Autonomous Communities and Local Councils now play a leading role in this area.
In the case of the Basque Country, Law 2/2006 of 30 June on Land and Urban Planning applies.
This is a subject that requires significant specialisation and knowledge, given the significant financial impact that any administrative action can have on the properties affected.
